L-1A Visa/Status – International Executive Transferee

The development of new technologies and business models has led to what we now term “globalization” of the economy. Companies often seek to expand their reach beyond the borders within which they are founded and they frequently depend upon the ability to recruit the best and brightest employees wherever they may plan growth. Though all members of a company are critical to its success, the specialized knowledge and experience of its executives and managers are often in high demand for the accomplishment of important corporate objectives. This being the case, it is often necessary to transfer executives or managers from abroad to a company location in the United States.

To ensure that you have access to your company’s overseas workforce, it is important to understand the immigration process. Let us help you with your efforts to obtain an L-1A Visa for your employee. Contact an Austin immigration lawyer of the Law Office of William Jang, PLLC at 512-323-2333 to speak with a skilled and experienced attorney about your case.

Basic Requirements:

L-1A Visa/Status is available for executives and managers who transfer from a foreign company to a subsidiary, parent or affiliate US company. In order to qualify the transferee must have worked for the foreign company for one continuous year within the preceding three years before he/she transferred to the United States. Both the US company and the related foreign company must be doing business. In addition, the transferee must be qualified to perform the offered position.

Duration of Stay:

L-1A Status may be granted for up to three years. But for newly established companies, US CIS typically grants status for only one year. As long as the both US company and the related foreign company is doing business and continues to be affiliated, and the employee is still engaged in executive or managerial work for the US company, L-1A status can be extended up to a maximum of seven years (typically two to three years at a time).

Family Members:

Spouses and children (under 21 and not married) are eligible to obtain L-2 status, which is a derivative status. They are allowed to accompany the L-1A transferee and remain in the United States. In addition, spouses may apply for employment authorization, and once approved, may work at any legal jobs. Individuals holding L-2 status may also attend schools.
