Employment Authorization

Basic Requirements:

Aliens in the following categories are eligible to obtain Employment Authorization. Once Employment Authorization Document (EAD) is received, the alien is authorized to work in the U.S. during the validity periods. The categories eligible to obtain Employment Authorization includes the following:

  1. Adjustment of Status Applicants (individuals with pending adjustment of status applications);
  2. Spouses of E-1 Treaty Trader or E2 Investor;
  3. Spouses of L-1 International Company Transferee;
  4. K-1 Fiance(e);
  5. K-3 Spouses of U.S. Citizens;
  6. F-1 Students seeking Optional Practical Training, seeking employment due to sever economic hardship, or seeking employment with a Qualifying International Organization;
  7. J-2 Spouse or Minor Child of an Exchange Visitor;
  8. Aliens in Temporary Protected Status (TPS);
  9. Asylee (Granted Asylum) and Asylum Applicants (individuals with pending asylum applications;
  10. Aliens Paroled as a Refuge;
  11. Dependents of Employees of Diplomatic Missions, International Organizations, or NATO;
  12. Some Domestic Servants;
  13. Some Individuals employed by a foreign airline;
  14. V-1, V-2, or V3 nonimmigrant;
  15. T-1, T-2, T-3 and T-4 nonimmigrant;
  16. U-1, U-2. U-3, U-4 and U-5 non-immigrant.
