The Immigrant Investor Visa Program

U.S. immigration laws give preference to individuals who seek residency status based on employment or close family connections. Citizens of other countries who wish to immigrate to the United States for employment or business purposes must fall into one of five visa preference categories. The fifth employment-based visa category was created by Congress in 1990 and awards visas to immigrants who invest in new or struggling businesses and create employment opportunities for U.S. workers.

EB-5 Immigrant Investor Visa

You can qualify for an EB-5 Immigrant Investor Visa by either creating a new business enterprise or by investing in a troubled business. Investors are required to:

  • Invest at least $1 million, or $500,000 in targeted employment areas such as very rural areas or towns with high unemployment rates
  • Be involved in the management of a business, either directly or through membership on a board

New businesses must create at least 10 full time jobs for U.S. workers, and must provide either goods or services to benefit the U.S. economy. Qualifying troubled businesses must be at least two years old and have incurred a certain amount of net losses over a set period of time before the immigration petition may be filed. Additionally, the number of jobs at the troubled business may not drop below the numbers of jobs present at the time of the initial investment.
