Proposed I-601 Waiver Changes

The United States Citizenship and Immigration Services (USCIS) recently announced a proposal to change the way in which individuals barred from legally entering the United States may apply for a waiver to their status. The proposal, which would allow individuals unlawfully living in the United States to leave the country to apply for citizenship without becoming subject to the ten-year entry bar, has not yet gone into effect. The policy would apply to individuals who can demonstrate an extreme hardship to certain relatives who are U.S. citizens

Currently, individuals who have lived in the United States illegally for a period of one year or longer are subject to an automatic bar against re-entry for ten years upon leaving the country. This can have profoundly negative effects for those seeking to apply for permanent legal residency, as filing this application must be conducted outside of the U.S. The new policy would allow individuals in this position to ascertain whether or not they would be granted a waiver to this bar before leaving the country.

Who it Affects

The change to I-610 Waiver policy will only apply to individuals in specific circumstances. Individuals in the following circumstances would be eligible for the waiver:

  • Spouses of U.S. citizens
  • Children of U.S. citizens
  • Parents of U.S. citizens

It is important to remember that this policy has not yet gone into effect, and is only a proposal at this time.
