Gaining Legal Permanent Residence After Conditional Status

Some immigrants to the United States are provided with visas that contain certain limitations and conditions. Before your visa expires, you must apply to have these conditions removed so that you can become a legal permanent resident without condition. If you do not apply to remove the conditions, or if your application is denied, your visa becomes invalid and you may not remain in the country.

Understanding Conditional Visas

Individuals who hold conditional visas are required to meet the specified conditions before the conditional status can be removed. There are two primary situations in which conditional visas are awarded:

  • Family-based immigration: Spouses that have been married for less than two years
  • Employment-based immigration: Participants in the Immigrant Investor Program

At the end of the conditional visa term, individuals must demonstrate that they have remained in compliance with the regulations of their particular visa program. If so, they may be awarded legal permanent residence without conditions for a period of ten years, and may apply for citizenship after a certain period of time has passed. However, if they are no longer in compliance with their visa conditions, their visa may expire and they may be forced to leave the country.
