Extending Your Stay in the U.S.

If you are a visitor to the United States holding a nonimmigrant visa and wish to extend your stay beyond your visa limits, you should file Form I-539 with the U.S. Citizenship and Immigration Service to request an extension. You should file this document at least 45 days before your visa expires. Failure to gain official approval to renew your visa and overstay your original authorized departure date may prevent you from qualifying for a visa in the future.

Qualifying for a Visa Extension

Only certain people are eligible to apply for a nonimmigrant visa extension, including those who:

  • Entered the U.S. lawfully with a nonimmigrant visa
  • Hold current valid nonimmigrant visa status
  • Have not committed any crimes
  • Have not violated any visa conditions
  • Hold a current valid passport that will remain valid throughout the stay

However, if you are not eligible to extend your stay or your request is denied, you must depart the country on or before your last authorized day to be in the U.S. If you fail to leave or overstay your visa limits by even one day, your status will expire and you may be ineligible to apply for a future visa or to return to the U.S.
