Changes Proposed to Certain Waivers of Inadmissibility

Recent reports from the United States Citizenship and Immigration Services state that lawmakers are considering a change to U.S. immigration laws that will affect foreign family members of U.S. citizens who are looking to immigrate to the U.S. The changes would reduce the amount of time that U.S. citizens and their non-citizen family members have to spend apart during the citizenship application period.

Currently, even immediate relatives are required to spend months apart from their loved ones while waiting for their paperwork to be processed by the United States immigration services. If the proposed changes go through, the spouses, children, and other immediate relatives of U.S. citizens will be able to join their family member much more quickly.

In order to ensure that this change is successful, policy makers will most likely re-do the form that immediate family member are required to fill out when applying for a provisional unlawful presence waiver. The changes will not go into effect until after the comment period ends on June 1, 2012. After this time, all information will be considered and a decision will be passed regarding the potential changes.
