Applying for U.S. Citizenship

Foreign citizens who wish to become American citizens may apply for U.S. citizenship through the United States Citizenship and Immigration Services (USCIS). Before petitioning for citizenship, however, there are many residency requirements that an applicant must meet. U.S. citizenship is not granted to everyone, and many people who apply are at least initially denied. Assistance from an experienced Austin immigration attorney can increase your chances of successfully filing for citizenship.

Application Requirements

Those who are not granted citizenship based on the Child Citizenship Act of 2000 must undergo a unique application process to apply for citizenship. Some of the important application requirements for citizenship include:

  • Be 18 years old or older
  • Be a permanent resident for at least 5 years (in some cases a shorter duration qualifies a person for citizenship)
  • Have a period of continually residing and being physically present in the U.S.
  • Be a person of good moral character (no criminal convictions or other problems while residing in the U.S.)

Those foreign citizens who are married to a U.S. citizen may apply for citizenship after 3 years of marriage to the U.S. citizen spouse. Permanent residents who have served in the U.S. military may apply after completing 1 year of service. However, the application must be submitted while serving or within 6 months of leaving the service to be considered under the one-year allowance.

Testing Requirements

Applicants for citizenship must also meet some specific testing requirements. A permanent resident applying for U.S. citizenship must:

  • Have the ability to read and write English at an elementary level
  • Understand the fundamentals of U.S. history and government

Some people can have these requirements waived, such as applicants over 50 years old, those who have been a permanent resident for 20 years or more, or those over 55 who have been a resident for 15 years or more.
