L-1B Visa/Status – Specialized Knowledge Transferee

Bringing those employees to the United States for a transfer assignment can be part of your corporate strategy, but it will require you to obtain the appropriate visa/status from United States Bureau of Citizenship and Immigration Services.

Basic Requirements:

L-1B Visa/Status is available for Specialized Knowledge Transferees who transfer from a foreign company to a subsidiary, parent or affiliate US company. In order to qualify the transferee must have worked for the foreign company for one continuous year within the preceding three years before he/she transferred to the United States. Both the US company and the related foreign company must be doing business. In addition the transferee must be qualified to perform the offered position and must have specialized knowledge.

Duration of Stay:

L-1B Status may be granted for up to three years. But for newly established companies, US CIS typically grants status for only one year. As long as the both US company and the related foreign company is doing business and continues to be affiliated, and the employee is still engaged in specialized knowledge work for the US company, L-1B status can be extended up to a maximum of five years (typically two to three years at a time).

Family Members:

Spouses and children (under age 21 and unmarried) are eligible to obtain L-2 status, which is a derivative status. They are allowed to accompany the L-1B transferee and remain in the United States. In addition, spouses may apply for employment authorization, and once approved, may work at any legal jobs. Individuals holding L-2 status may also attend schools.

  • $3,000.00 attorney’s fees for the principal beneficiary petition
  • $350.00 attorney’s fees for family (if family is accompanying)
  • $325.00 US CIS filing fee for the main petition
  • $290.00 US CIS filing fee for the family’s application (if family is accompanying)
  • $500.00 US CIS Fraud Prevention and Detection Fee (for initial petition)
  • $1,225.00 US CIS filing fee for premium processing (optional)
  • $380.00 US CIS filing fee for spouse’s employment authorization (optional)
