FBI – Spouses of Citizens Removal of Condition

Basic Requirements:

Spouses of U.S. Citizens who have been married less than two years at the time their immediate relative petition (green card) is approved will obtain conditional permanent residence, which will expire in two years.  They must apply for Removal of Condition in order to become unconditional permanent residents.   Unless the marriage has ended the Removal of Condition application must be filed not more than three months prior to the expiration of the permanent resident status at the earliest and prior to the expiration of the permanent resident status at the latest.   If the couple has divorced or if the U.S. Citizen spouse is deceased, then the removal of condition application may be filed immediately after the marriage has ended.  If the Condition is not removed, then the permanent residency will expire and the immigrant spouse will lose his/her permanent residency (green card).

Family Members of the Immigrating Spouse:

Although there is no derivative status for immediate family members of U.S. Citizens, children of the immigrating spouse who also obtained their permanent residency based on a step children –step parent relationship must also remove the condition if they obtained their status less than two years of the parent/step parent’s marriage.

If the couple is still married:

  • $1,500.00 attorney’s fees
  • $   590.00 US CIS filing fee

If the couple is no longer married:

  • $2,500.00 attorney’s fees
  • $   590.00 US CIS filing fee
