EB-3 Third Preference – Employment Based Immigration Other Workers (Unskilled Workers)

Basic Requirements:

Third Preference Employment Based Immigration EB3 (Green Card) is available for Other Workers (Unskilled Workers). In order to qualify under this category, the worker must be able capable of performing unskilled labor. Unskilled labor is denied as labor requiring less than two years of training or experience to perform. Being classified as an unskilled worker has major negative consequences in terms of immigrant visa availability.

Application Process:

This employment based preference category requires that the employer first obtain Labor Certification (PERM) from the Department of Labor. A specific job offer is also required in the Third Preference Employment Based category. In addition after receiving Labor Certification, the Petitioner (Employer) must file for an Immigrant Petition. Individuals are allowed to file for adjustment of status or proceed with consular processing only when their visas become numerically available. Unfortunately due to significant backlogs, individuals in this preference category must typically wait many years for their visas to become available. Unkilled Workers face the longest wait time. Unskilled Workers from most countries typically have to wait nine years or more. Individuals from India, China Mexico, and Philippines may have to wait even longer. The immediate un-availability of this category will likely to continue for individuals.

Family Members:

Spouse and children (under 21 and not married) are eligible to obtain green cards as a derivatives if accompanying the main beneficiary.

Fees:

Step 1: Labor Certification

  • $3,000.00 attorney’s fees
  • Cost of advertising the position (varies)

Step 2: Permanent Residency Petition

  • $1,000.00 attorney’s fees
  • $ 580.00 US CIS filing fee for the main petition

Step 3: Adjustment of Status

  • $4,000.00 attorney’s fees for the principal beneficiary and his/her immediate family
  • $ 1,070.00 for each person ($635.00 for each person under 14 years of age)
