Bill for lifting green card cap stopped in Senate

A bill that would lift the cap on green cards for high-tech, skilled, foreign workers was approved 389-15 by the House, but has been stopped in the Senate.

The bill is aimed not to allow more people into the country, but to lift the cap of green cards awarded to applicants from certain countries. Advocates for the bill argue that immigrants from large countries are at a significant disadvantage, specifically skilled workers from China and India.

The bill would also not necessarily take jobs from Americans. Before an employer can file for an immigrant worker’s green card, the company has to prove it cannot find American workers with the same skill level, which is usually at least a bachelor’s degree.

Police looking for driver of hit-and-run crash

The Austin Police Department is searching for a driver who hit and killed a bicyclist Monday night.

Several 911 calls were made after drivers saw a man in the road. By the time officers arrived, the man was already dead. The 26 year-old man was lying on the road near Research Boulevard and the Oak Knoll exit.

Authorities believe the victim was riding a bike when he was struck from behind. He was not wearing any reflective gear or a helmet. Police have little to go on to find the driver who hit him. APD had nearly 8,500 reported hit-and-run accidents last year and made only 287 arrests.

Immigration overhaul to focus on criminal charges

The U.S. Immigration and Customs Enforcement (ICE) has enacted a new policy in which federal immigration authorities will drop deportation cases against illegal immigrants who do not have criminal backgrounds.

Many cases against students, veterans, and other illegal immigrants with close family ties to the United States will be dropped so ICE can focus on deporting individuals with criminal histories. A pilot project of the policy in Denver resulted in 10 to 15 percent of the deportation cases being dismissed.

Federal immigration authorities are instructed to prioritize their deportation cases by focusing on individuals who have repeatedly violated immigration laws or have played the system.

Obama admin. proposes change to immigration law

On Friday, the Obama administration proposed a change to the current immigration law that requires illegal immigrants to leave the country before asking for a waive on the usual three to 10 year-ban before legally returning to the United States.

The new rule would allow spouses and children of the illegal immigrant to ask the government for a waive on the ban before they leave the country. While the visa process must still be completed in their home country, the waiver process could be cut short from months to weeks or days. The administration stated the change is to avoid separating families for long periods of time due to bureaucratic delays.

Immigrants without a criminal record who can prove that their absence would be a hardship on their families can also win a waiver. Last year, 23,000 immigrants applied for hardship applications and more than 70 percent were approved.

ICE creates hotline for detainees

The U.S. Immigration and Customs Enforcement agency, ICE, has launched a telephone hotline for detainees held by state or local police.

Detainees can call the toll free hotline at (855) 448-6903 if they believe they are U.S. citizens or have wrongly been accused of a crime. The number will be in operation 24 hours a day, seven days a week by ICE staff with several interpreters. After prisoners call in, ICE personnel will forward their information to proper ICE Enforcement and Removal Operations offices for action.

The ICE has come under fire for allowing local police agencies to arrest suspected illegal immigrants. Under the 287(g) program, police can be deputized to turn suspects over to immigration authorities when local police are not normally allowed to enforce federal laws.

More international students coming to US for business

According to a recent report by the Council of Graduate Schools, more international students are coming to the United States for MBA degrees.

From 2010, total international student enrollment in graduate schools increased by six percent and mostly for business degrees. This is the largest increase in international students coming to America for graduate school since 2007. The Johnson Graduate School of Management at Cornell University saw an increase in international enrollment by 12 percent from just last year.

Most students are from Taiwan, China, and Vietnam hoping to get their MBAs and return to their home country in order to get a running head start in multinational companies.

Amtrak and truck collide in north Austin

An Amtrak passenger train and a pickup truck collided in Hutto, a city northeast of Austin, Sunday morning injuring the driver.

According to a Texas Department of Public Safety trooper, the train blew its whistle as the conductor saw the truck attempting to cross the tracks. The 44 year-old driver of the truck continued to drive despite the warnings and was ejected from the vehicle when the train hit him.

All 200+ passengers were evacuated from the train as diesel fuel began leaking. The truck driver is currently in critical condition at Round Rock’s Seton Medical Center Williamson. Two passengers in the train were injured, but did not require medical assistance.

Immigration detention centers violate human rights, says report

Three immigration detention centers in Illinois and Kentucky have come under fire recently after advocates at the National Immigrant Justice Center and the Midwest Coalition for Human Rights say detainees have been denied basic human rights.

Their report states that the prisoners at the detention centers have been denied or received poor medical care, have been denied legal counsel, rarely eat a hot meal, and are not provided with simple amenities such as blankets. The advocacy groups have visited the three centers over twenty times since 2009.

Some detainees have reported that doctors told them they had to pay for medical care, they are kept in excessively cold rooms, and could not see a doctor for potential cancer-related symptoms; one HIV-positive inmate was unable to see a doctor for six weeks.

House votes to end per country caps on worker visas

Last week the House voted on a bill that would end per-country caps on worker-based immigration visas. The bill passed 389-15.

This new law would overwrite the current law that limits a country’s employment-based visas to 7% of all visas given out. That means skilled workers from China or India who come to the United States for college could more easily obtain citizenship. Green cards and permanent resident visas would be handled on a first-come, first-serve basis.

The caps on family-based visas will also be changed from 7% to 15% per country.

Many immigration advocates say the new law does little to help immigrants, but is a step in the right direction.

Alabama immigration law challenged by Justice Department

Alabama’s immigration law, H.B. 56, heralded as the toughest immigration law in the nation, has been challenged in federal court by the Justice Department.

This week, two officials from the Justice Department will visit Alabama to gather more information about the impact and legality of the law. The assistant attorney general of the Department’s Civil Rights Division says he is concerned after hearing that thousands of children have dropped out of school following the law’s passing. He also believes H.B. 56 has led to racial profiling and employers using the law not to pay workers.

Another official states that the federal government has primacy in regulating immigration, and that state’s individual immigration laws make the problem worse.
