When to Apply for a Reentry Permit

If you are a legal permanent resident of the U.S. and plan to travel abroad, you may want to apply for a reentry permit to help protect your residency status. If you travel abroad for more than one year without a reentry permit, your green card will be considered to have expired. Additionally, if you take up residence in another country during your trip, even if you’ve been gone less than one year, your status may also expire.

Reentry Permits for Legal Permanent Residents

To avoid potential complications when returning to the U.S. after traveling, permanent residents should file Form I-131 with the U.S. Citizenship and Immigration Services to receive a reentry permit at least two months before their intended departure date. This form must be filed when the applicant is physically present in the U.S. After a reentry permit is awarded, you may be able to:

  • Travel abroad for up to two years
  • Travel without a passport from your home country

Legal permanent residents who travel for extended periods of time without a reentry permit run the risk of having their green cards expire. In this case, you may have to make an appearance before an immigration judge who will evaluate your residency and reentry.
