Conditional Permanent Residents
Legal permanent residents carry green cards to show proof of their authorization to live and work in the U.S. Most green cards are valid for 10 years, while green cards for conditional permanent residents are valid for only two years. These conditional cards cannot be renewed. To retain their residency status beyond this time period, conditional permanent residents must petition to have their conditional status removed before the card expires. If the condition is not removed, the card expires and the person loses residency status.
Sometimes people run into problems when attempting to obtain legal permanent residency. If you or a loved one is having trouble obtaining, retaining, or renewing a green card, contact the Austin permanent residence attorneys at the Law Office of William Jang, PLLC, at 512-323-2333.
Removing Conditional Permanent Residence
Conditional permanent residence may be granted to the following types of individuals:
- A citizen of another country who marries a U.S. citizen
- Entrepreneurs who invest a specified amount of money in a company and create full-time jobs for at least 10 qualified employees
After a period of two years, these residents must remove green card conditions to become a legal permanent resident. Those who qualified for conditional residency based on marriage must file Form I-751, Petition to Remove the Conditions of Residence, while those who qualified based on investment must file Form I-829, Petition by Entrepreneur to Remove Conditions.
